This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 101 of 2022 registered with Belwandi Police Station, Dist. Ahmednagar for the offences punishable under Sections 307, 327, 452, 336, 337, 326, 324, 323, 143, 147, 148, 149, 504, 506 and 120-B of the Indian Penal Code and under Section 4 read with Section 25 of the Arms Act, 1959. 2.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

The name of the applicant does not figure in the F.I.R. The F.I.R. has been lodged on 27th March, 2022. After ten days of registration of the crime, injured Prashant gave a statement alleging the applicant herein to have assaulted him with a spade handle. Admittedly, Prashant suffered two simple injuries.

In view of above, the application deserves to be allowed. Hence I pass the following order :-

ORDER

(I) The bail application is allowed.

(II) The applicant be released, in connection with Crime No. 101 of 2022 registered with Belwandi Police Station, Dist. Ahmednagar for the offences punishable under Sections 307, 327, 452, 336, 337, 326, 324, 323, 143, 147, 148, 149, 504, 506 and 120-B of the Indian Penal Code and under Section 4 read with Section 25 of the Arms Act, 1959, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.

(III) The applicant shall not tamper with the prosecution evidence.
