The learned counsel for the appellant -Insurance Company ,on instructions, submits that the appellant -Insurance Company wants to withdraw this matter. A purshis along with letter from the concerned appellant -Insurance Company is also on record. It is marked 'X' for identification.

The learned counsel for the claimants has no objection for such withdrawal.

However, the learned counsel for respondent No.3- owner of the offending vehicle submits that he would go with his cross objection.

In view of the same, First Appeal No. 1101/2012 stands withdrawn and disposed of along with the pending Civil Applications, if any.

5.

The respondent Nos. 1 and 2-claimants are permitted to withdraw the remaining amount of compensation along with the accrued interest thereon till date.

The cross objections shall continue.
