According to the learned counsel for the appellant, the present appeal is arising out of the same acquisition proceeding which was the subject matter of First Appeal No. 233/2006 and connected appeals disposed of vide order dated 21.12.2013 by this Court, wherein this court has granted compensation @ Rs.750/- per Are for seasonally irrigated land and Rs.1000/- per Are for Bagayat land. Learned AGP accepts that the present appeal is in respect of the same acquisition proceeding as decided by this Court in First Appeal No. 233/2006 and connected appeals.

In the light of that, for the reasons stated in order dated 21.12.2013 passed in First Appeal No. 233/2006 and connected appeals, the present appellant is 1/2

901.doc entitled for compensation @ Rs.750/- per Are. Other statutory benefit as awarded by the reference court is upheld and maintained.

The first appeal is accordingly disposed of. No costs.
