Mr. Sonwalkar submits that the petitioners may be allowed to withdraw the present application, however, liberty to move the trial Court for amendment to the plaint, may be granted.

Allowed to withdraw with the liberty to the petitioners to file application in the trial Court, which shall be decided by the learned trial Court on its own merit, subject to the valid objection from the other side.

Civil Revision Application is accordingly disposed of without any order as to costs.
