PER COURT :- 1.

The applicant / management and the non-applicant / workman place on record compromise terms which are in Marathi language, dated 11.5.2016. It is jointly submitted that this Civil Application can be allowed and the judgment of this Court dated 22.3.2016 can be modified in terms of the compromise.

The compromise terms are taken on record and marked Exhibit "X" for identification.

Considering the above and the statement made on instructions from the non-applicant / workman present in the Court, this Civil Application is allowed and the judgment of this Court dated 22.3.2016 in Writ Petition No.2435 of 2009 is modified by consent in terms of Exhibit "X". 4.

The applicant makes a statement that the amount of money payable to the workman as per Exhibit "X" shall be so paid within ten days. Statement is accepted.
