1 WP - 4988-2018
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 4988 OF 2018 MAHANANDA DNYANOBA MURALE
VERSUS
LAHU TULSIRAM PATIL AND OTHERS ...
Mr. B.R. Kedar, Advocate for petitioner Mr. S.B. Ghatol Patil, Advocate h/f Mr. D.N. Gilche, Advocate for respondent no.3 Mr. S.N. Kendre, AGP for respondent-State ...
CORAM : SUNIL P. DESHMUKH, J.
DATE : 18-06-2018 ORDER :
1.
Heard learned counsel for the parties.
2.
Learned counsel for the petitioner submits that while appeal has been preferred against the declaration of his disqualification by Collector, application for interim relief has been moved, however, that has been rejected and has refused to stay order impugned in the appeal. He further purports to submit that on the last date i.e. on 06-06-2018, when the matter had been before this court, it was sought to be submitted on behalf of other side that the appeal pending before the Commissioner was scheduled for hearing on that day and, as such, consideration of the writ petition had been deferred.
2 WP - 4988-2018 3.
Learned counsel for the parties, however, fairly concur that now the next date scheduled before the Commissioner is 27-06-2018 and record in the appeal is awaited. 4.
Having regard to aforesaid position, it appears to be expedient that appellate authority to see that the record is received and the matter is heard and disposed of in reasonable time. Till the final conclusion by the Commissioner, subsisting position as on the date, shall continue. As such, status-quo on the date, be maintained till the decision in appeal. Appellate authority to proceed with the appeal expeditiously and in any case, dispose the same of by 10-07-2018.
5.
Writ petition disposed of.
