The petitioner's proposal seeking validation of his claim of belonging to 'Thakur - Scheduled Tribe Category' is pending since 17th July, 2018. The petitioner is in employment with the Maharashtra State Road Transport Corporation, Buldhana. 2.

Since Mr. D. S. Bagul, learned advocate, appears for the M.S.R.T.C. Buldhana, we requested him to cause his appearance in this matter.

Considering the above and since the learned AGP submits that the Committee would decide the claim of the petitioner expeditiously, this petition is partly allowed with the following

2 913-WP-5046-2023.odt directions : - [a] The petitioner's claim shall be decided on or before 31st December, 2023 keeping in view the order dated 05th December, 2018 passed by this court in his Writ Petition No. 13502 of 2018.

[b] The petitioner shall render wholehearted cooperation to the Committee and shall refrain from seeking adjournment on unreasonable / frivolous grounds, lest the Committee would be justified in progressing to the next stages in the matter.

[c] If the Committee arrives at an adverse conclusion, the same shall not be effective for a period of fifteen (15) days from the date of the decision, to enable him to take recourse to a legal remedy.

[d] The respondent - M.S.R.T.C. shall not terminate the services of the petitioner until 31st December, 2023 or till the date of the passing of the order, whichever is earlier, and subject to the above direction.
