1] Criminal Application No.1672 of 2025 stands allowed.

2] Heard learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the assist to public prosecutor.

3] The applicant is seeking bail as he was arrested on 01.04.2025 in connection with Crime No.0058/2025, dated 06.02.2025, registered with Gandhi Chowk Police Station, District Latur, for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023.

4] The complainant, who at the relevant time was married lady filed a complaint against the applicant that the applicant maintained physical relations with the complainant on the promise of marriage and that she became pregnant. She was forced to abort the pregnancy on account of the pressure from the applicant. The applicant has breached the promise of marriage. It is stated that the applicant maintained physical relations with the complainant from 2019 to December 2024. The complainant submits that the complainant has obtained divorce from her husband in November 2024. The allegations in complaint are specific towards maintaining sexual relations with the victim on the false promise of marriage, although, at the relevant time, she was a married lady. It is stated that the applicant has antecedent in the form that he is convicted for the offence under the Prevention of Corruption Act and that he has been dismissed from the service as Gramsevak.

5] The applicant is in custody from 01.04.2025.

Charge-sheet is filed in the matter, since, the complainant was already married, sexual intercourse on the basis of false promise of marriage may be doubtful and that it can be proved at the time of trial. The applicant, thus, can be granted bail

6] The learned APP and the learned counsel for the assist to public prosecutor has objected for grant of bail. 7] In view of the above, the application is allowed in the following terms :

a] The applicant shall be released on bail in connection with Crime No.0058/2025, dated 06.02.2025, registered with Gandhi Chowk Police Station, District Latur, for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023, on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

b] The applicant, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial. c] The applicant shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court.

d] The applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case.

e] The applicant, upon being released on bail, shall place on record of the trial Court the details of his Contact Number and residential address with updates in case of any change.

8] Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled.

9] It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.

10] The application stands disposed of.
