We have heard the learned Advocate for the petitioner.

It is submitted that under the impugned communication the Collector has bestowed powers to deal with the application U/Sec. 107(11)(d-1) (vi) of the Maharashtra Co-operative Societies Rules, 1961 to the office of the District Deputy Registrar. The said powers only vest with the District Magistrate.

The learned Additional Government Pleader has placed on record the communication received by her stating that the proposal has been verified and it is found that there are some deficiencies and under letter dated 01.10.2021 the communication has been made to the Special Recovery Officer to comply with the deficiencies and thereafter the decision would be taken by the office of the Additional Collector, Jalna.

As the defect is sought to be rectified, the writ petitions are disposed of. No costs.
