This is an application filed under the provisions of Section 439 of the Criminal Procedure Code in connection with Crime No. 401 of 2016, registered with Jinsi police station, Aurangabad for the offence punishable under Section 307 r/w 34 of the Indian Penal Code.

I have gone through the contents of the first information report as well as papers of investigation. There is no specific allegation against the present applicant about the act or overt act in reference to the crime. My attention

crap2273.17 is drawn to the order passed by this Court on 8.3.2017 by which this Court has granted bail to the accused who was standing on the same footing and the allegations against that accused are also similar. In such circumstances, I am of the opinion that the applicant is entitled for bail. 3.

Hence, Criminal Application is allowed.

Applicant be released on bail in connection with Crime No. 401 of 2016, registered with Jinsi police station, Aurangabad for the offence punishable under Section 307 r/w 34 of the Indian Penal Code on furnishing P.R. bond of Rs. 25,000/- with one surety in the like amount.
