Mr Ghanekar, learned Counsel appearing on behalf of the applicant makes a submission that the applicant undertakes to appear in the Sessions Case No. 129 of 2011, pending before the learned Sessions Court on each and every day, but for the exemption, if any required to be prayed from the Court in exceptional case.

Having regard to the conduct of the applicant, who has appeared before the learned trial Court and prayed for cancellation of non-bailable warrant, in my opinion, it will be appropriate to order the release of the applicant and is accordingly released, subject to payment of cost of Rs. 10,000/- to be paid to the Library, Advocates Association of Bombay High Court, Bench at Aurangabad, within period of 15 days from today.

The oral undertaking of the advocate shall remain intact till conclusion of the trial. It is made clear that single default on the part of applicant or his lawyer, may result in passing appropriate order against the applicant by the learned Sessions Judge.

The applicant be released on bail on same terms, on which he was admitted on bail on earlier occasion.
