By the present application, the applicant seeks his release on bail. 3.

It is claimed by the learned Counsel appearing on behalf of applicant that, in view of the law laid down by the Apex Court in the matter of Dilip S. Dahanukar Vs. Kotak Mahindra Co. Ltd. & anr. reported in 2008(1) M.H.L.J. (S.C.) 22, out of the total amount of compensation awarded i.e. Rs. 16,000/-, he has already deposited Rs. 4,000/-, before the learned trial Court.

He submits that, the applicant was on bail during the trial, so also before the learned appellate Court and has not misused the liberty. 4.

In the above background, in my opinion, the applicant is entitled to be released on bail. Hence, I pass following order : Applicant be admitted on bail on the same terms as were imposed by the learned Court below while granting bail. Criminal Application stands allowed in above terms.
