The present application is filed for transfer of the divorce proceedings initiated by the respondent - husband bearing Marriage Petition No. 245 of 2023 from the Civil Judge, Senior Division, Kalyan, Thane to the Civil Judge, Senior Division, Dhule. 3.

It is the case of the applicant - wife that she married with the respondent - husband on 23.01.2022 and on account of certain dispute with the husband the applicant is now residing with her parents at Dhule. The distance between Kalyan to Dhule is 320 Kms. and that she has no independent source of income and that the respondent - husband is in a private job and that he is in a position to conduct the proceedings at

2 962 Dhule, whereas it would be inconvenient for the applicant to defned the proceedings at Kalyan.

The learned counsel appearing for the respondent - husband does not seriously contested the transfer petition, however, the learned counsel submits that the petition on being transfer to Dhule be decided as expeditiously as possible.

The learned counsel appearing for the applicant submits that the applicant would not seek unnecessary adjournments if the petition is transferred to Dhule and the applicant would co-operate in early disposal of the petition at Dhule.

Having considered the rival submissions I deem it appropriate that it would be inconvenient for the wife to defend the proceedings at Kalyan and that the proceedings be transferred to Dhule. The Miscellaneous Civil Application is allowed in terms of prayer clause "B". However, it is directed that the appropriate court shall decide the divorce proceedings as expeditiously as possible and it is directed that the applicant - wife not to seek unnecessary adjournments and would cooperate to decide the matter as expeditiously as possible. In the event the applicant seeks adjournment in the matter, she would ordinarily intimate

3 962 the same to the respondent - husband well in advance so that he does not have to travel to Dhule only for the adjournment of the matter. 7.

The Miscellaneous Civil Application stands accordingly disposed of.
