After hearing, learned Counsel for the Applicants and learned APP for State, on instructions, learned Counsel for the Applicant does not press the application of Vitthal s/o Baburao Latpate. As such application against the Applicant No.2, is dismissed. 2.

Applicants were apprehending the arrest in connection with Crime No.137/2021 registered with Gangakhed Police Station District Parbhani under Section 307 of the Indian Penal Code, 1860. Complainant, Sushant Munde (injured), alleged, Applicant No.2 inflicted a blow of iron rod on his head> whereas Applicant No. 1 1/2

943-ABA -632-2021.doc inflicted a kick on his private part> whereas Applicant No.3 - Dnyanoba Latpate threatened him of a dire consequences if he would file a complaint. Learned APP has produced a medical certificate and discharge summary of Superspeciality Hospital, where Sushant Munde (injured) was admitted for treatment after the incident. The report/ discharge summary does not indicate injury on the private part of the Sushant Munde (injured), but to say corresponding injury allegedly caused by the iron rod, was noted.

In view of the facts of the case, the pre-arrest protection is granted to Applicant No. 1 and Applicant No. 3 on executing P.R. Bond in the sum of Rs.10,000/- with one or more sureties in the like amount. Both shall join the investigation as and when called by the Investigating Oficer.

Application is allowed in the aforesaid terms and disposed of accordingly.
