Mr. Irale Patil, learned Counsel appearing for the petitioner submitted that during pendency of the petition, an order is passed by the Chief Executive Officer, Zilla Parishad, Aurangabad dated 05.09.2019, whereby the Chief Executive Officer, Zilla Parishad, Aurangabad treated the period from 12.01.2016 to 01.12.2016 as "permissible leave period" in view of the provisions of Maharashtra Civil Services (Suspension) Rules, 1981 and more particularly Rule 72 thereof. It is also stated that

(2) CP-348.19.odt the order of Chief Executive Officer is subject to the review application filed on behalf of Chief Executive Officer before the Divisional Officer.

The order passed by Chief Executive Officer, Zilla Parishad, Aurangabad dated 05.09.2019 is taken on record and marked 'X' for identification.

Mr. Irale Patil, learned Counsel appearing for the petitioner submits that in view of the order passed by the Chief Executive Officer, the grievance of the petitioner no more survives.

In view of the submission made by learned Counsel appearing for the petitioner, the petition is disposed of accordingly.
