Heard. perused the impugned order passed by respondent NO.1 canceling the petitioner's tribe certificate.

The petitioner is permitted to withdraw this petition with liberty to file fresh petition, if the cause of action arises to him.

The petitioner is also at liberty to take such certificate issued to him afresh by respondent NO.2 to respondent NO.1 for validation.

Respondent No.1 shall consider the case

wp5124.16 on merits and decide it within one year. In the meantime respondent No.4 shall not terminate the petitioner's service on the ground that he does not possess requisite tribe certificate and its validation. If in case, respondent No.1 passed adverse order to the petitioner, he is at liberty to approach this Court challenging such order.

In view of this the writ petition stands disposed of as withdrawn.
