Delay of 109 days is caused in filing the Family Court Appeal. 2.

We have considered the submissions of the learned advocates for the respective sides. The learned advocate for the Respondent has vehemently opposed the application for condonation of delay and prays that the same may be dismissed by imposing cost of Rupees One Lakh. 3.

The delay is not too long and does not appear to be deliberate. As such, for the reasons set out in the application, the same is allowed. The delay of 109 days is condoned.

The Family Court Appeal be registered.

The learned advocate for the Appellant submits that she desires to undergo a round of mediation at the High Court level with an attempt to save her marriage. The learned advocate for the Respondent submits that the mediation may be caused to find out whether a solution to the marital discord could be explored. Both suggest the name of learned advocate Smt. S.T. Kazi. 6.

In view of the above, office to process the papers so as to be delivered to Mrs. Kazi. The learned advocates are at liberty to contact the learned Mediator for an early initiation of the mediation proceedings. Liberty to circulate the Family Court Appeal after the mediation proceedings are concluded.
