AND CRIMINAL WRIT PETITION NO.738 OF 2022 VINOD BHIMRAO MAGARE & OTHERS

VERSUS

THE STATE OF MAHARASHTRA & OTHERS ...

Advocate for the petitioners : Mr.N.S.Kadarale APP for Respondent-State : Mr.S.J.Salgare ...

CORAM : C.V. BHADANG & S.G.DIGE, JJ.

DATE : 6 JUNE 2022 P.C. :

1.

These petitions are filed for a direction to the respondents to issue any notice or summons to the petitioners asking them to surrender until further order of the Supreme Court in Suo Motu Writ Petition No.1 of 2020.

737.WP+ 2.

Learned counsel for the petitioners states that except four petitioners, all other petitioners have surrendered. Learned counsel for the petitioners pointed out that these petitioners, who have not surrendered, have not yet received any notice, which aspect is disputed by the learned APP.

3.

We do not find it necessary to dwell on this aspect inasmuch as Suo Motu Writ Petition No.1 of 2020 has been disposed of by the Supreme Court by order dated 03.06.2022, copy of which is taken on record and marked 'X' for identification.

4.

We, therefore, find that the principal relief does not survive in view of the fact that the said Suo Motu Petition has been disposed of. In such circumstances, Writ Petitions are accordingly disposed of.
