Heard the learned counsel for the applicant and the learned counsel for the respondent.

The applicants are claiming bail in C.R.No.248 of 2023 registered at Pathardi Police Station, District Ahmednagar, for the offences punishable under Sections 307, 326. 325, 324, 323, 427, 143, 147, 148, 149, 504 and 506 of the Indian Penal Code. 3.
After having gone through the papers and considering the arguments, the Court expressed disinclination to grant bail to applicant No.1 Arjun Lahanu Gore. The learned counsel for the applicant on instruction seeks leave to withdraw his application. Leave granted. His application stands dismissed as withdrawn.

As per the role attributed to the other co-accused, the role is different from the applicant No.1 Arjun. The parties are fighting over the land dispute. The incident happened in the land of applicant. The counter report is also filed. The material investigation against them is over. No purpose would be served keeping them behind bar. In the facts and circumstances, they deserve bail. Hence, the order:- i) Bail application of Applicants No.2 and 3 is allowed. ii) Applicants Nos. (2) Bhausaheb Arjun Gore and (3) Baban Shripati Darkunde, be released on bail, on furnishing PB and SB of Rs.50,000/- each, with one solvent surety of the like amount, in the aforesaid crime, on the conditions that they shall stay away from the village for a month from the date of his release.
