The petitioner impugns order dated 11.07.2023 passed by learned Judge, Family Court at Beed in Petition No.A-145/2021 by which petitioner is directed to pay interim maintenance of Rs.7000/- per month to respondent-wife.

Heard learned Advocate appearing for petitioner. 3.
He endeavours to point out that respondent-wife is serving as Nurse on contract basis and getting amount of Rs.25,643/- per month. He would further submit that, as per contents of the FIR in Crime No. 952/2022 registered at Wakad Police Station, she is living an adulterous life and, therefore, is not entitled to any maintenance.

Perusal of impugned order shows that respondent-wife is residing at Pune and she is taking care of son born out of marriage
(2) 28-wp-8139-2025.odt with petitioner. She has filed on record document indicating school expenses and house rent. Apart from that, it is brought on record that petitioner has raised loan from Tata Capital Service and EMI of Rs.2914/- is deducted from contractual salary of respondent-wife. Above circumstances clearly shows that it is difficult for wife to maintain herself and her son with her earning from contractual job. So far as contentions regarding averments in FIR, those would be irrelevant at this stage. Undisputedly, matrimonial relationship between parties still subsists and petitioner-husband is under statutory obligation to maintain respondent-wife. 5.
In that view of the matter, this Court do not find any reason to interfere in impugned order granting meager interim maintenance of Rs.7000/- per month. In result, Writ Petition stands dismissed.
