This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.20/2019, registered with Rahata Police Station, District Ahmednagar for the offence punishable under Sections 302 and 201 of the Indian Penal Code. 2.

It is informed that the charge has been framed. It is, therefore, not desirable for this Court to make any observations about the merits of the case. Suffice it to say that the applicant herein is a woman. She is alleged to have killed her husband by serving him poisonous substance through meal. There is statement of the daughter of the applicant indicating that there was a quarrel between the two

on the fateful day. The deceased would suspect character of the applicant.

The F.I.R. has been lodged by a Police Naik on 31/1/2019, nine days after the deceased breathed his last. Since the applicant being a woman and behind the bars about about 3 1⁄2 years and has two minor children to look after them, this Court is inclined to grant bail to the applicant. Hence the order :-

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail Crime No.20/2019, registered with Rahata Police Station, District Ahmednagar for the offence punishable under Sections 302 and 201 of the Indian Penal Code on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount.

(iii) The applicant shall not tamper with the prosecution evidence.
