Learned counsel for the petitioner submitted that the respondent has published fresh advertisement and the petitioner has participated in response to that advertisement also. The learned counsel submitted that pendency of the present matter should not come in the way either of the petitioner or the authority to consider the application of the petitioner. This Court

2 WP 5155 of 2016 makes it clear that such matter needs to be dealt with independently on its own merits.

2) As the petitioner has filed application in response to the advertisement said application can be considered on its own merits. So Writ Petition No.5155 of 2016 is disposed of with directions that such application be decided on its own merits. It should not happen that the petitioner has approached this Court by filing writ petition is taken as a circumstance adverse against the petitioner.
