Heard learned counsel for the applicant. The learned Counsel for the sole respondent, despite last chance, failed to appear. No reply is filed by the respondent. 2.

The application is filed for condonation of delay of 1369 days in filing the second appeal. There is no oppose to the application, but considering the huge delay the application stands allowed in terms of prayer clause (A) to cost of 2,000/- with the Library, Advocates Association of High Court, Bombay, Bench at Aurangabad within three weeks. The appeal be registered after removal of office objections, if any after deposit of cost.
