CORAM : R.M. BORDE & A.M. DHAVALE, JJ (Date: 5TH JUNE, 2018) PER COURT :- The petitioners are in receipt of the certificates issued by

{2} the Sub Divisional Officer, certifying that they belong to 'Mannerwarlu ', scheduled tribe. The concerned official, while issuing the certificates, committed a trifle mistake in recording the name of the tribe. The spelling of the tribe is recorded as ' Mannerwarlu ' in stead of ' Mannervarlu '.

As a consequence of recording wrong spelling of the tribe in the certificates, the scrutiny committee, has surprisingly refused to accept the proposals for verification of the tribe claims. It is noticed that the scrutiny committee is refusing to perform its' statutory obligation of verification of the tribe claims on the basis of merit, by quoting one reason or the other, which has resulted in generation of unnecessary litigation. This Court has issued directions, several times, not to refrain from performing their legal and statutory obligation by raising technical objections. The scrutiny committee should have accepted the proposals directing the petitioners to produce the corrected certificates recording the correct spelling of the tribe within specific time frame.

In the facts and circumstances, these petitions can be disposed of by directing the Sub Divisional Officer to issue correct tribe certificates recording the name of the tribe as 'Mannervarlu ' without embarking upon further enquiry into the

{3} matter and on the strength of the certificates already issued to the petitioners, as expeditiously as possible and preferably within a period of two weeks from today.

With the directions as above, the writ petitions are disposed of.
