Mr Dande, the learned A.G.P. placed on record the letter of the Education Officer and submits that the Education Officer would reconsider the proposal in view of the Circular dated 28.6.2016. 2.

Under our judgment dated 4.7.2019 in Writ Petition No. 1493 of 2018 with connected matters, we have already considered the aspect of transfer of a person from unaided to aided post. We have also observed that the Government Resolution dated 4.5.2020 would not apply to the appointments made prior to 4.5.2020.

In light of that, the impugned order is set aside. The Education Officer shall re-consider the proposal seeking approval to the transfer of the petitioner from unaided to aided post in tune with the judgment dated 4.7.2019 in Writ Petition No. 1493 of 2018. The same be considered within a period of four months.

Writ Petition disposed of. No costs.
