Heard the learned counsel for the applicant, learned APP for the respondents-State and learned counsel for the victim/respondent No.3.

The applicant seeks bail in Crime No.407 of 2023, registered with Nanalpeth Police Station, District Parbhani, for the offences punishable under Sections 376, 376(2)(3), 327, 342 of the IPC, Sections 4 and 17 of the POCSO Act and Sections 9, 10 and 11 of the Prevention of Child Marriage Act. 3.

Admittedly, the applicant runs a Marriage Bureau. It is his profession to arrange the marriages. The mother of the victim was also with him. He just facilitated the performance

of marriage through his marriage bureau. For his services to fix the marriage, he was charging money. In this case, after the marriage, the dispute arose and the crime was registered. One document of birth and Aadhar card were found fabricated in his office. However, it is difficult to accept that he was the author to fabricate the document. He runs the marriage bureau. He may rely upon the information supplied to him. The marriage was consensus and not forceful. There was no antecedents to his discredit. Considering his role, it would be inappropriate to keep him behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant RAJU DEVRAO SAVLE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) He shall not tamper with the prosecution witnesses.

(b) He shall attend the trial on each and every effective date.

(iii) The Secretary, High Court Legal Services, SubCommittee, Aurangabad do pay the legal fees to advocate Mr. Shinde, as per the schedule.
