Vide order dated 11/06/2015, this Court had noted the absence of the petitioner on the earlier dates. Matter was kept for dismissal on 18/06/2015.

On 18/06/2015, none appeared for the petitioner. Matter was posted on 23/06/2015 for passing orders.

On 23/06/2015, the learned Advocate appeared for the petitioner and intimated that the Company has already been closed down 15 years ago. So also, the Jogeshwari factory has been closed down.

On 09/07/2015 and 23/07/2015, the matter was adjourned at the request of the learned Advocate for the petitioner as he had khs/Aug. 2015/2659-94-d
intimated that the Company is considering taking steps in this matter.

On 04/08/2015, none appeared for the petitioner even at the second call. Even today, none appears for the petitioner at the second call.

Mr.Choudhari, learned Advocate submits that the State Bank of India has issued a statement dated 07/07/2015 indicating the status of the amount invested in Fixed Deposit. 7.
In the light of the above, this petition is dismissed for nonprosecution. Rule is discharged. 8.
Pending civil applications, do not survive, hence shall stand disposed of.

The statement issued by the State Bank of India dated 07/07/2015 is taken on record and marked as Exhibit "X" for identification. The respondent office of the Provident Fund at Aurangabad shall be at liberty to withdraw the said amount after 6 (six) weeks from today with accrued interest. ( RAVINDRA V.
