DATE : 20.12.2021 PER COURT :- Parties have fled joint pursis and it is stated that the original complainant-respondent No.1 Shashikant Anandrao Hivale is ready to withdraw proceeding No. R.C.C. No. 251 of 2013 unconditionally pending on the fle of learned Chief Judicial Magistrate, Ahmednagar.

It is further stated that respondent No.1, who is original complainant had already fled pursis before the trial Court for withdrawal of the complaint case, but as there is stay order passed by this Court, the trial Court is not permitting to withdraw the same. It is stated that the stay order be vacated.

Considering the fact that complainant/ respondent No.1 wants to withdraw the complaint case itself fled by him, there is no point in keeping the present application under Section 482 of the Code of Criminal Procedure fled for quashing of the said complaint case. The present application is thus disposed of. 4.
