CORAM : R.M. BORDE & A.M. DHAVALE, JJ (Date: 5TH JUNE, 2018) PER COURT :- The petitioner claims to belong to 'Koli Mahadev', scheduled tribe. He is in receipt of the certificate issued by the Sub Divisional Officer on 13.9.2013, certifying that the petitioner belongs to Mahadev Koli, scheduled tribe. The nomenclature of the tribe recorded in the Constitutional Order is 'Koli Mahadev' and not 'Mahadev Koli'. Since the certificate issued to the petitioner records the name of the tribe as 'Mahadev Koli', the scrutiny committee did nto accept the proposal for verification of the tribe claim and returned the same to the petitioner. The petitioner again approached the Sub divisional Officer by presenting an application, requesting for issuance of the tribe

{2} wp 5133.18.odt certificate recording the correct name of the tribe i.e. 'Koli Mahadev'. The Sub Divsiional Officer, it is informed that, has not considered the same.

In the circumstances, this petition can be disposed of by directing the Sub Divsional Officer, Nanded to issue tribe certificate to the petitioner, certifying t hat he belongs to 'Koli Mahadev', scheduled tribe. The Subdivsiional Officer, without embarking upon further enquiry into the matter, on the strength of the certificate issued to the petitioner earlier on 13.9.2013, shall issue the certificate, as direced above, within a period of two weeks from today.

With the directions as above, the writ petition is disposed of.
