Heard. There is direct evidence, corroborated with medical evidence. We do not wish to elaborate the evidence since the appeal filed by the applicant is pending. Suffice it to say that the findings recorded by the trial Court prima facie appear to be in consonance with the record. The application stands rejected.

Registry to send back the original record and proceedings to the registry of Sessions Court, Omerga. Upon receiving the original record and proceedings, registry of the concerned Court to prepare Paper Book and send it along with the original record and proceedings to the registry of this Court as expeditiously as possible, however, within three months from today. Upon receiving the Paper Book and original record and proceedings, liberty to the counsel for applicant to apply for early hearing of the Criminal Appeal.
