After hearing the matter for considerable length, learned counsel appearing for parties resile to the situation that it would be appropriate to decide application Exhibit-18-D filed by the present respondents in regular darkhast no. 33 of 1999 pending before the Civil Judge, Junior Division, Patoda.

As such, having regard to the facts and circumstances, it would be expedient that instead of deciding present writ petition on merits, executing court proceeds with application Exhibit-18-D filed by

WP-5323.15 respondents and decide the same as early as possible, preferably within a period of twelve weeks, from the receipt of writ of this order on its own merits without getting influenced by earlier order. 3.
