Vide order dated 6th June 2022 and on specific submission that the applicant is trying to explore the possibility of settlement, the sentence awarded by the courts below was suspended till the next date, i.e.05-07-2022. 2.

On 05-07-2022, learned counsel for respondent no.1 appeared and sought time.

Today, the learned counsel for respondent no.1 submits that while obtaining such relief the applicant is not approaching respondents for any settlement.

Learned counsel for applicant submits that the son of applicant approached the society in the last week. That they are asking more amount than mentioned in the cheque. He submits that he is ready and willing to settle the matter and also ready to deposit Rs.50,000/- within three weeks from today with the respondent no.1 - Society. 5.

Both the parties submits that the matter could be settled, if referred to mediation.

In the meantime, the matter is referred to the Mediation. 7.

The Secretary, District Legal Services Authority, Ahmednagar shall appoint the Mediator from the panel and parties shall appear before the Secretary, District Legal Services Authority, Ahmednagar on 23rd September 2022.

On appearance, the Secretary shall appoint a Mediator and accordingly directed the parties to appear before the Mediator. 9.

The learned Mediator shall submit his report preferably within one month from the date of first appearance of the parties before him. 10.

It is made clear that the order of suspension of sentence is subject to deposit of Rs.50,000/- within a period of three weeks from today with respondent no.1 - Society.

If such amount is not deposited, the order of suspension shall be revoked automatically without reference to the court. 12.

Criminal application no. 1783 of 2022 is therefore disposed of. 13.

Place the revision application before the court only after receipt of report from the Mediator.
