This Court disposed Criminal Application No.2554 of 2012 and connected matters by judgment dated 21st December, 2012 and while disposing the matters, the Trial Magistrate was directed to dispose the matters pending before him within one year from the date of receipt of copy of the judgment. As the trial could not be completed as per the directions, the Trial Magistrate requested for extension of time on six occasions, which is granted by this Court. Now again a communication dated 24th October, 2016 is received from the learned Additional Chief Judicial Magistrate, Ambajogai, seeking extension of one year to dispose the matter. One of the reasons given by the learned Magistrate is that police machinery is not making sincere efforts to secure
( 2 ) cria2554.12 presence of the witnesses. Mr. A.R. Kale, learned A.P.P. was called upon to look into the matter and take instructions from the P.S.O., Dindrud and Dharur. On instructions, the learned A.P.P. assured that the police machinery will co-operate and take all efforts for early disposal of the matter.

The learned Trial Magistrate is granted six months' time to dispose the matter. The trial should be conducted on day-to-day basis, if required. If the police machinery does not co-operate, the learned Trial Magistrate shall immediately point out to this Court about it by sending appropriate communication. 03.
The learned A.P.P. shall inform the P.S.O. Dindrud and Dharur that if it is found that the police machinery is not co-operating with the learned Trial Magistrate for disposal of the matter, appropriate orders will be passed recording the conduct of the concerned officials. The learned A.P.P. shall send copy of this order to the P.S.O. Dindrud and Dharur.
