Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/ State.

The applicant is seeking bail in Crime No. 262/201 registered with Police Station Khultabad, District Aurangabad for the offences punishable under Sections 120-B, 394, 395 and 397 of the Indian Penal Code.

The learned counsel for the applicant submits that initially report was lodged against two persons only. The applicant has not been identified in the test identification parade. The only evidence against the applicant is recovery of Rs. 30,000/-. There are no antecedents to his discredit. The co-accused have been granted bail. Considering the facts and circumstances of the case and period

39-BA-805-23.odt required to conclude the trial, no harm would be caused to the prosecution if bail is granted on the certain conditions. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Vijay Shantilal Chandwade be released on bail on furnishing P. B. and S.B. of Rs. 50,000/- with one solvent surety of the like amount, in aforementioned crime registered with aforementioned police station, on the following conditions :- (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the trial on each and every effective date.

(c) He shall not involve in the similar crime.
