The grievance of the petitioner appears to be that, though, the appeal filed before the Additional Divisional Commissioner is allowed and the penalty imposed is set aside, still, the amount of Rs.1,00,000/- deposited by the petitioner is not refunded to him.

The affidavit-in-reply is filed by the NaibTahsildar. It is stated that because of Covid-19 pandemic much attention could not be given to the application of the petitioner. The deponent has assured that the deponent will take further steps for refund of the amount to the petitioner.

It is clear that the respondents are not disputing the amount payable to the petitioner. The payment of the amount as payable to the petitioner shall be made preferably within a period of three (03) months.

Writ Petition is accordingly disposed of. No costs.
