Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.536 of 2022 registered with CIDCO Police Station, District Aurangabad for the offence punishable under Section 177, 302, 323, 506 r/w 34 of Indian Penal Code.

The facts of the case reveals that the deceased and the applicant had a mutton shop beside each other. They had a quarrel over the business. The role attributed to the applicant as per the FIR reveals that he barely slapped and kicked the deceased. There are no allegations that the applicant has used the weapon to commit the crime. It was a quarrel arising out of the business. Nothing is to be recovered from the applicant. The charge sheet has been filed.

929-ba-812-2023.odt (2) Considering the role attributed to the applicant, it would be unjustifiable to keep the applicant behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Rahim Qureshi Gulam Rasul Qureshi, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall stay away from Aurangabad for three months from the date of his release.
