Entitlement of the petitioner for pay fixation in accordance with the recommendations of the sixth and seventh pay commission is the matter under consideration. It is pointed out that similarly placed Lecturers of the same establishment had approached this Court in writ petition no. 4137 of 2023 (Sayyad Jamir Shabbir and others Vs. The State of Maharashtra and others) and in similar circumstances, vide order dated 18 April 2023, the petition was disposed of by directing evaluation of the entitlement of the petitioners therein for grant of pay according to the fifth, sixth and seventh pay commission recommendations.

The learned AGP submits that it is the respondents nos. 3 and 4 who would be competent to consider the case of the present petitioner as well.

In the light of the above, we allow the writ petition and direct the respondents nos. 3 and 4 to take appropriate decision in respect of entitlement of the petitioners for pay fixation. 5.

The decision shall be taken as expeditiously as possible and in any case within two months.
