Heard learned counsel for the applicant and learned APP for the respondent - State.

The applicant seeks bail in Crime No.0155 of 2021 registered with Savada Police Station, Taluka-Raver, District-
Jalgaon for the offence punishable under Sections 365, 302, 201 read with Section 34 of the Indian Penal Code. 3.
The prosecution case is that after the co-accused committed murder of the truck driver, the applicant helped the co-accused to dispose of the truck.

Prima facie, it appears that the applicant was not accompanying the main accused who committed the murder of the driver of the truck.

The prosecution has apprehension that the applicant may abscond as he was arrested after about two and half years of the incident. The applicant is having no antecedents to his discredit and he has been languished in jail since 10th March 2024. Nothing is to be recovered from the applicant. He has roots in Aurangabad. Considering the role attributed to the applicant, his detention would serve no purpose. Hence the applicant deserves bail on certain conditions. Hence the following order:-
O R D E R
(I) Bail Application is allowed.
(II) Applicant - Sanjay S/o Bhujangrao Kshirsagar be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in above crime, on the condition that:- (a) The applicant shall not tamper with the prosecution witnesses.
(b) The applicant shall attend the trial on each and every effective date.
(c) The applicant shall not change his residential address without the leave of the Court.
