Counsel appearing for the respondents states that, merely a notice is issued to the petitioner calling upon him to show cause as to why action shall not be taken under the provisions of section 52, 53 and 54 of the Maharashtra Regional Town Planning Act. The petitioner may tender his reply and thereafter, the concerned authority may pass appropriate order.

Learned counsel for the petitioner states on
{2} 917WP5586-18 instructions that the petitioner will tender reply within a period of four weeks from today. On receipt of the reply, the respondents may pass an appropriate order within contemplation of provisions of law within a period of four weeks. The counsel appearing for the respondent-Municipal Council on instructions, states that since the Municipal Council is expected to pass an order on consideration of the reply that would be tendered by the petitioner, no adverse action would be taken against the petitioner until the Municipal Council passes the order in furtherance to the notice dated 07.05.2018.
