Heard Mr. Solunke, the learned counsel for the applicant and learned APP for the State.

This is an application under section 438 of the Criminal Procedure Code in connection with Crime No.25/2017, registered with Majalgaon City Police station, District Beed for the offences punishable under sections 452, 395, 323, 504, 506 r/w 34 of the Indian Penal Code.

Allegations against the present applicant are that he has assaulted the informant with iron rod and snatched an amount of Rs.5,000/- from the pocket of the informant. On perusal of the say submitted by the prosecution before the learned Additional Sessions Judge, it appears that custody of the applicant is 1/2

902apln2296.odt required for the purpose of recovery of the iron rod as well as the amount snatched.

Considering the nature of the allegation, I do think that custodial interrogation of the applicant is needed. Therefore, the applicant is not entitled for anticipatory bail. Criminal application is rejected. (K. L. WADANE, J.) JPC 2/2
