When this Court has shown its disinclination to grant relief to the applicant No.3-Angad Raosaheb Khule, learned counsel for the applicants, on instructions, seeks withdrawal of the application. Application is dismissed to the extent of applicant No.3. 2.

Perusal of the first information report shows that applicant No.2 is the person who had brought the vehicle in question to the office of Tahasildar, however, there is nothing to indicate that this applicant is responsible for the commission of theft of the sand. Apart from this, there is no allegation against him that he has caused any assault on the 23.aba700.23.odt

informant and his companions. There is nothing on record to indicate that any antecedents are there against him. In view of this, liberty of the applicant No.2-Amar Kisan Giri deserves to be protected in terms of interim order dated 3rd May, 2023.
