Anjana Machindra Gadhave v. Additional Divisional Commissioner, Nashik And Others
WP-5512.15
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
BENCH AT AURANGABAD.
WRIT PETITION NO. 5512 OF 2015 Smt. Anjana w/o Machindra Gadhave ...
Petitioner vs The Additional Divisional Commissioner, Nashik Division, Nashik and others ....
Respondents ----- Mr. Vivek V. Tarde, Advocate for petitioner Mr. S.P. Daund, Asstt. Govt. Pleader for respondents no. 1 to 3 Mrs. M.D. Thube-Mhase, Advocate for respondent no. 5 CORAM :
SUNIL P. DESHMUKH, J.
16TH JULY, 2015 ORDER:
1.
Emerging situation after hearing learned counsel for the parties on either side appears to be that, upon a communication by tahsildar with regard to the birth date, perhaps looking at the clear position that the petitioner apparently has a third child after the cut off date, interim relief has been vacated by respondent no. 1 on 23-03-2015 and since then it is not operating in favour of the petitioner.
2.
It appears that by now quite a few dates intervened in the proceedings in appeal. In the circumstances, instead of taking up the matter on merits it would be worthwhile to direct disposal
WP-5512.15 of the main appeal itself on merits within a period of three weeks days from the date of receipt of writ of this order. 3.
Learned counsel for petitioner submits that appeal otherwise is ready in all respects for hearing. 4.
Accordingly, writ petition is disposed of with direction that appeal be decided within a period of three weeks from the date of receipt of writ of this order.
