This is an application for anticipatory bail since the Applicant is apprehending his arrest in connection with Crime No. 25/2014 registered with City police station Ambajogai, Dist. Beed for the offences punishable u/s 457,380 of the Indian Penal Code.

Heard Mr. S.B.Bhapkar, learned counsel for the applicant and Mrs. S.G.Chincholkar, learned A.P.P. for respondent - State.

Hon'ble Vacation Judge has granted ad-interim anticipatory bail in favour of the applicant vide order dated 22/05/2015.

F.I.R. is lodged by Rameshwar Mahadeo Appa Banale on 02/02/2015. From the F.I.R., it is clear that it was lodged against unknown person, who has taken away bags of Soyabin and Pulses from his shop.

Learned A.P.P. on the basis of the investigation papers has submitted that during the course of investigation, Investigating Officer has arrested four persons, who are already released on bail by the learned trial Court. According to learned A.P.P., the only material against the present applicant is the statement of co-accused. Except the statement of co-accused, according to the investigation papers, there is no other material, is the submission of the learned A.P.P. 6.
In that view of the matter, present Criminal Application is required to be allowed and accordingly it is allowed and the order passed by the Hon'ble Vacation Judge on 22/05/2015 stands confirmed.

Present Criminal Application is disposed of.
