After hearing progressed to some length, Mr Girase, learned advocate appearing for the petitioner seeks leave to withdraw this writ petition and for refund of the amount that the petitioner had deposited pursuant to the order dated 7th September, 2020 of this Court. He also seeks liberty to pursue the remedies provided under the Code of Criminal Procedure (hereafter 'the Cr.P.C').

Leave, as prayed for, is granted. The writ petition stands dismissed as withdrawn, without costs. This order, however, shall not preclude the petitioner to pursue his remedy under the Cr.P.C. in accordance with law. All contentions are kept open.

The amount deposited by the petitioner in terms of the order dated 7th September, 2020 shall be refunded to him. Registry shall take appropriate steps if an approach is made in this behalf. 4.

In view of dismissal of the writ petition, nothing survives for decision in the Civil Application seeking intervention. The same stands disposed of, without costs.
