Per Court :- Present Criminal Application is filed by the applicant for grant of regular bail, in connection with CR No.28/2015 registered with Police Station, Shevgaon, District - Ahmednagar for the offences punishable under Section/s. 307, 498(A), 201, 323, 504, 506 read with 34 of the Indian Penal Code.

[2] Heard Mr. Narayan B. Narwade, Advocate for the Applicant and Mrs. S.G. Chincholkar, Additional Public Prosecutor for the State of Maharashtra.

[3] The applicant is the husband of injured Varsha. Their marriage took place about seven years prior to the incident i.e. 18th January, 2015. When Varsha was admitted in the Hospital, her two statements

2/2 cri.appln. 2686.15..sxw are recorded; one is by the Police Officer and another by Special Executive Magistrate. According to the said statements, she received burn injuries due to atrocious act of the present Applicant. Other accused - Nivrutti is already released on bail. According to the injury certificate, Varsha received 23 to 24% burn injuries. [4] In view of the survival of Varsha, there is no possibility of offence being turning into more graver one. Investigation is already over. Charge sheet is already filed. In that view of the matter, custodial presence of the presence applicant is not necessary. Hence, I pass the following order :-

ORDER

(i) Criminal Application is allowed.

(ii) Applicant - MAHADEO S/O MARUTI GHODAKE shall be released on regular bail on he executing P.R. Bond of Rs. 20,000/- [Rs. Twenty Thousand.] with one solvent surety in the like amount, in connection with CR No.28/2015 registered with Police Station, Shevgaon, District - Ahmednagar for the offences punishable under Section/s. 307, 498(A), 201, 323, 504, 506 reafd with 34 of the Indian Penal Code.

(iii) Bail before trial court.

(iv) With this Criminal Application is allowed and same is disposed of accordingly.
