Learned advocates are ad idem to pass the order similar to one dated 03.04.2024 passed in Writ Petition No.5849 of 2021. 2.

In view of the above, writ petitions stand disposed of in terms of following order :

ORDER

(i) Writ Petitions are allowed.

946 & 947.odt (2) (ii) The orders impugned herein issued by the Assistant Commissioner, Backward Class Cell, Nashik Region, Nashik are quashed and set aside and the concerned authority is directed to prepare and approve the roster in accordance with the provisions of Rule 9(7) of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981.

(iii) The respondent-authority shall consider the proposal for approval forwarded by the petitioners, strictly in accordance with the provisions of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981 and to take decision within a period of three months from today.
