Heard the learned advocates of both the sides. 2.

The learned advocates Mr. Kadam and Mr. Dighe who appear for the respondent Nos. 1/State Co-Operataive Election Authority and respondent No. 3/Returning Officer inform that today is the date for publication of final list of valid nominations and allotment of symbols. 3.

The petitioner is aggrieved by the decision of the respondent No. 3-Returning Officer and the respondent No. 2 appellate authority rejecting his nomination to the impending elections under the CoOperative Societies Act. 4.

Since the challenge is being put up when the election process is already underway and has reached at an advanced stage, as laid down in the matter of Dattatray Genaba Lole and others Vs. The Divisional Joint Registrar; 2022 (1) BCR 471 and as this Court has taken a consistent view to not to cause any interference at this interim stage, the Writ Petition is dismissed keeping open the right to prefer an election petition.
