VERSUS
The State of Maharashtra ..RESPONDENT Mr U.S. Malte, Advocate for applicant;
Mr S.R. Palnitkar, A.P.P. for respondent CORAM : N.W. SAMBRE, J.
DATE : 26th August, 2015 ORAL ORDER :
The applicant is seeking pre-arrest bail, in connection with C.R. No.3037 of 2015, registered with police station,Jintur, District Parbhani, for offences punishable under section 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and under sections 504 and 506 of the Indian Penal Code.
2.
The case of the prosecution is that the present applicant, on 27th March, 2015, insulted the complainant in public view and has uttered caste related accusation, when the complainant had come with a request for inspection and correction of the electric meter bill in the office of the applicant.
(2) criap2710.15 3.
It is required to be noted here, that the present applicant was already protected by this Court by an order dated 26th May, 2015. 4.
The applicant is a public servant. The accusations made against him appear to be during discharge of his official duty. There is hardly any likelihood that the applicant will run away from the clutches of law. 5.
Apart from above, the applicant has tried to establish that at the relevant time, when the incident took place, he was not in the office and there are false accusations made against him. 6.
In view of above background, in my opinion, it will be appropriate to allow the present application. I, therefore, pass following order :- Criminal Application stands allowed.
