The learned counsel for the appellant/claimant Mr. Hemant U Dhage along with appellant Mr. Bhausaheb Balu Kahmkar, learned counsel Mr. Sanket Kulkarni for respondent Nos. 1 to 5 along with respondents are present today.

With the assistance of the learned counsels, we have ascertained identification of the appellant and the respondent Nos. 1 to 5. They affirm the terms of settlement.

The learned counsel and the parties who are present have placed on record the terms of compromise. Same is taken on record and marked as Exhibit-X for identification.

FA-289-22 -25.

As per the terms of settlement Exhibit-X, the appellant shall deposit an additional amount of Rs. 6,16,250/- ( Rupees Six Lakh Sixteen Thousand, Two Hundred Fifty) towards full and final settlement before Motor Accidental Claim Tribunal, Shrigonda within a period of two weeks. The same is accepted as an undertaking. The amount deposited today by the appellant in this Court shall be transferred to Motor Accident Claim Tribunal, Shrigonda in pursuance of Execution Petition No. 5/2020) along with the accrued interest thereon. On deposition the amount, the respondents are permitted to withdraw the same.

The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act.

The first appeal stands disposed of in terms of the settlement Exhibit-X and present minutes of order.

8.

Award be drawn up accordingly.
