IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.5831 OF 2022 (VAIJANATH RAMKISHAN RENGE AND OTHERS VS THE STATE OF MAHARASHTRA AND OTHERS) Mr.P.D.Bachate, Advocate for the petitioners. Mr.S.B.Yawalkar, AGP for State.

( CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.) DATE : JUNE 24, 2022 PER COURT :

1.

The petitioners have approached this Court in anticipation of an adverse order being passed based upon an apprehension. Since the learned Advocate appeared very anxious at 10.30 am. today while mentioning the motion, that we have decided to grant him a slot on the production board.

2.

Having heard the learned Advocate for the petitioners for quite some time, we find that neither his anxiety is well placed nor is his apprehension based on any foundation. The notice dated 01.06.2022 issued by the respondent/Deputy Commissioner u/s 20(2) of the M. L. R.Code, 1966, has been received by him. He has appeared in the khs/June 2022/5831

- 2 - matter and he has also submitted his written say on the merits of the matter.

3.

In the above backdrop, we are surprised as to why has the petitioner developed so much of anxiety when the competent authority would be considering all his contentions. Now the matter is posted on 28.06.2022 for passing orders.

4.

Since the petitioner has raised an objection as regards maintainability and has also addressed the authority on merits, we are sure that the competent authority will consider all the grounds raised by all the litigating parties and deal with them squarely within the ambit of Law. The learned AGP submits that an order on the basis of the pleadings of the parties would be passed by considering all contentions.

5.

As such, this petition is disposed off. Pending civil application, does not survive and stands disposed off.
